I. General provisions These Regulations define the rules for using the online store available at http://dihelen.pl/
The owner of the online store is Olena Didukh (NIP 6762636231) based in Kraków at Sodowa 19, 30-376 Kraków.
By placing an Order, the Customer declares that he has read the Regulations, in particular with the possibility of withdrawing from the contract, in accordance with the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended). ; and accepts its provisions.
II. Definitions The terms used in the Regulations mean:
Customer - a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions, who places an Order in the Di Helen Store; Civil Code - Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
Consumer - a natural person - including a natural person running a sole proprietorship - who concludes a legal transaction with the Di Helen Store (including an Order), provided that it is not of a professional nature for him, resulting in particular from the subject of his business activity. , made available on the basis of the provisions on the Central Registration and Information on Business. Di Helen online store (Di Helen Store) - online service available at http://dihelen.pl/ through which the Customer may, in particular, place Orders;
Goods – products presented in the Di Helen Store; Order - the Customer's declaration of will, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.
III. Rules for making purchases
A. General Provisions
The sales contract is concluded between the customer placing the order (Customer) and the Di Helen Store.
The price applicable to the product at the time the Customer places the Order is binding on the parties to the transaction. The prices presented in the Di Helen Store do not include the costs of shipping the Goods, which are presented to the Customer before he or she accepts the Order.
Orders can be placed via the Di Helen Store 24 hours a day, every day of the week, except for periods related to technical and maintenance breaks.
The Customer may also place an Order by phone during the working hours and days of the Customer Service Department.
The condition for placing an Order is to fill in the form with all required data necessary for shipment or system generation of a sales document. The data provided must be true and current.
The Customer may modify the Order and contact details until the Order is finally confirmed.
After placing the Order, the Customer will receive information summarizing the purchase by e-mail, or in the case of telephone orders: by e-mail, text message or via instant messaging.
The Di Helen store confirms acceptance of the order for processing via e-mail. Confirmation of order acceptance is a declaration of acceptance of the offer. Upon confirmation of acceptance of the order, a contract is concluded between the Customer and the Di Helen Store.
The Di Helen store reserves 2 days to confirm acceptance of the order from the moment the order is received. Lack of confirmation within the above deadline means no conclusion of the Agreement, and all payments made by the Customer will be immediately refunded. Di Helen Store reserves the right to refuse to process an Order if the Customer's personal data is false, the transaction has not been authorized in the electronic payment system or the payment for the Order has not been made within the specified time.
B. PAYMENT
The Di Helen store accepts payments via the PayU payment system
Di Helen Store reserves the right to refuse to process an Order in the event of incorrect/incomplete completion of the Order form (lack of all necessary data needed to complete the Order).
D. SHIPPING
An order placed on a business day will be processed within 1-2 business days, after the day on which the Di Helen Store recorded the prepayment or after the day on which the payment method was selected. Orders placed on non-working days will be processed on the first business day following the day on which the Di Helen Store recorded the prepayment. In the case of payment by card, the delivery time is counted from the moment of positive authorization of the transaction.
We process orders via the InPost courier company
The delivery cost of each Order is calculated individually based on information about the Seller of the ordered Goods, the weight of the Goods, the region and method of delivery, as well as (if necessary) the form of payment and indicated on the Website at the last stage of the Order.
The ordered Goods are sent to the address indicated in the form as the delivery address.
In case of shipment outside the European Union, the customer is obliged to cover the costs related to customs clearance, if such fees apply in a given country.
In the event of the Customer's negligence or refusal to accept the Order sent outside the European Union (export invoice), Di Helen has the right to deduct the costs of such reimbursement from the payment made by the Customer. For economic reasons (the cost of return exceeds the value of the Order), Di Helen also has the right to abandon such a shipment without the obligation to return the payment made for the Order to the Consumer.
IV. Withdrawal from the contract, returns, complaints, exchanges
A. WITHDRAWAL FROM THE CONTRACT, RETURNS
The Customer who is a Consumer has the right to withdraw from the contract within 14 days (in words: fourteen), counted from the date of receipt of the ordered Goods, without giving a reason.
The right to withdraw from the contract is not available in the cases specified in Art. 38 of the Act of May 30, 2014 on Consumer Rights, in particular in a situation where the subject of the contract is a non-fabricated item, manufactured according to the Consumer's specifications or intended to meet his individual needs, as well as in cases where the original packaging of the item has been damaged or unsealed.
The returned goods must be in undeteriorated condition, unless the change was necessary within the scope of ordinary management, and have the original tags. For safety and hygiene reasons, the following cannot be returned: underwear (i.e. panties, panties, thongs, boxers, scrubs, underpants), masks, bodysuits, art. hygiene products, self-supporting bras and accessories, goods purchased on special terms, i.e. in particular damaged goods, second quality goods.
The Goods returned by the Consumer should be packaged in an appropriate manner to ensure no damage during transport; if possible, the Goods should be packed in the original packaging. Please note that there must be no visible signs of use on the product or original packaging. Damaged, incomplete or dirty assortment (including packaging) is not subject to return or exchange and will be sent back to the Consumer at his/her expense.
If you wish to return the Goods paid for with a Merchandise Voucher, the Consumer will not be entitled to a cash refund, but will have the right to receive a Merchandise Voucher with an equivalent value of the returned products.
If there is a need to refund funds for a transaction made by the customer with a payment card, the seller will refund the amount to the bank account assigned to the Ordering Party's payment card.
In the event of Customer negligence and additional costs related to the return of an order sent outside the European Union (export invoice), Di Helen has the right to deduct such costs from the Customer's payment for the Order.
The Di Helen Store must be informed by the Consumer about withdrawal from the contract.
The Consumer is obliged to return the received Goods at his own expense, and the Di Helen Store is obliged to refund to the Consumer all payments made by him, including the costs of delivery of the Goods, with the exception of additional costs resulting from the delivery method chosen by the Consumer other than the cheapest, regular delivery method available in Di Helen Store and with the exception of the costs of returning the received Goods and with the exception of the costs related to the Consumer's return of the Goods for which he withdrew from the contract.
The Di helen store refunds the payment only after receiving the return of the Goods. The payment is refunded using the same payment method used by the Consumer, unless the Consumer has agreed to a different method of return.
B. COMPLAINTS
Complaints are considered in accordance with the provisions of the Act of April 23, 1964. - Civil Code.
The Customer may complain about the Goods if they have defects about which they were not informed, e.g. in the Goods description. In the case of a Customer who is a Consumer, the Di Helen Store is liable under the warranty for physical and legal defects under the terms set out in the Civil Code. Complaints will be considered within 14 days of submitting the complaint by the Customer.
Goods purchased in the dihelen.pl online store may only be advertised in the dihelen.pl online store.

Di Helen may repair the Goods as part of an accepted complaint - however, if this is impossible, the Customer may:
a) request a refund - the amount he paid for the Goods is returned to his bank account (the exception is Goods purchased using a Shopping Voucher)
b) replace the Goods with the same ones - if available in the Di Helen Store,
c) replace the Goods with another one - in the event of a difference in value, the Customer may receive the difference amount or pay it additionally to Di Helen's account
V. Personal data protection
The principles of personal data protection are included in the Privacy Policy.
VI. Final Provisions
Di Helen reserves the right to:
a) changes in prices and quantities of Goods offered by the Di Helen Store
b) withdrawal of individual Goods from the offer of the Di Helen Store
c) carrying out and canceling all types of promotional campaigns and sales.
d) changes to the regulations for important technical, legal and/or organizational reasons.
Shop amended regulations. Orders placed by customers before the changes to the regulations come into force are processed in accordance with the existing provisions of the regulations.
The settlement of any disputes arising between the Di Helen Store and the Customer who is a Consumer shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure. The Di Helen Store also informs the Consumer that it is possible to use out-of-court methods of resolving disputes and pursuing claims, including arbitration, mediation and arbitration, the rules of which and the rules of access to procedures are determined by the competent arbitration, mediation and judicial centers. amicable and result from applicable legal provisions.
The settlement of any disputes arising between the Di Helen Store and a Customer who is not a Consumer shall be submitted to the court having jurisdiction over the seat of the Di Helen Store.
If the Customer is a natural person, a legal person or an organizational unit that is not a legal person and has its place of residence/registered office outside the territory of Poland, the Parties agree that the legal relationship between them in connection with the placed Order and the concluded sales contract will be the provisions of Polish law will apply, and any dispute will be resolved by the competent Polish common court, in accordance with the procedural provisions of Polish law.
The Regulations enter into force on April 5, 2022 and apply to orders placed after that date.
